The Seller is generally responsible for the Product, including its:

• Authenticity
• Description
• Availability
• Pricing
• Warranty
• Legal compliance
• Packaging
• Fulfillment
• After-sales service

Most Here provides marketplace, technology, customer experience, payment, marketing, logistics, and other services depending on the applicable transaction and Seller arrangement.

2. Acceptance of These Terms

4. Marketplace Services

Most Here provides a digital marketplace where Customers can discover, compare, and purchase Products offered by participating Sellers.

4.1

Product listings may be created and managed by independent Sellers.

4.2

Product prices, descriptions, images, specifications, availability, promotions, and other information may be supplied or updated by Sellers.

4.3

Most Here may review, format, organize, modify, remove, or restrict listings to maintain Platform quality and compliance.

4.4

The appearance of a Product on Most Here does not necessarily mean that Most Here manufactures, owns, imports, or directly sells that Product.

4.5

Where Most Here is itself the Seller of a Product, this may be expressly identified on the relevant Product or transaction page.

5. Product Information

Most Here aims to provide Customers with useful and accurate Product information. However, information for marketplace Products may originate from Sellers or other third parties.

Before placing an Order, Customers should carefully review:

• Description
• Specifications
• Size and dimensions
• Color or variant
• Quantity
• Price
• Availability
• Warranty
• Delivery information
• Return conditions
• Seller information

The Seller remains responsible for ensuring that the Product information it provides is accurate and not misleading.

6.2

Prices and availability may change before an Order is successfully confirmed.

6.3

Most Here may correct obvious pricing, technical, inventory, or listing errors where reasonably necessary.

6.5

Promotional offers may be subject to additional terms, eligibility requirements, quantities, time limits, or availability restrictions.

A Product being displayed on the Platform does not guarantee that it will remain available until the Customer completes the purchase process.

7. Orders and Purchase Confirmation

7.1

Submitting an Order constitutes a request to purchase the selected Product under the applicable transaction terms.

7.2

An Order may be subject to Seller acceptance, Product availability, payment authorization, fraud screening, inventory confirmation, and other reasonable verification processes.

7.3

Most Here may cancel or restrict an Order where:

• The Product is unavailable
• The listed price contains an obvious error
• Payment cannot be authorized
• Fraud or abuse is suspected
• The Order violates Platform policies
• The Seller cannot fulfill the Order
• Required information is incomplete
• Cancellation is required by law or a competent authority

7.4

Where an Order is cancelled after payment has been collected, applicable amounts will be refunded in accordance with the relevant payment and refund process.

8.2

Customers should provide complete and accurate delivery information.

Additional delivery attempts or costs may apply where an Order cannot be delivered because of incorrect information, recipient unavailability, or other Customer-related circumstances, subject to applicable policy and law.

Most Here may remove Products or restrict Seller accounts where it reasonably believes that a listing or Seller activity violates applicable law, these Terms, or Platform policies.

• Engage in activity that could harm Customers, Sellers, or Most Here

Most Here may take appropriate action, including account restriction, suspension, cancellation of transactions, reporting to relevant authorities, or legal action where appropriate.

Customers may be permitted to submit reviews, ratings, photographs, comments, or other content.

• Unauthorized use of a Customer's account resulting from the Customer's failure to protect account credentials

Nothing in these Terms is intended to exclude liability where such exclusion is prohibited by applicable law.

23. Indemnification

To the extent permitted by applicable law, a user or Seller may be responsible for losses, claims, damages, penalties, or reasonable costs arising from their:

• Breach of these Terms

• Illegal activity

• Unauthorized use of another person's information
• Violation of applicable law

Additional indemnification obligations may apply to Sellers under the Most Here Seller Agreement.
